Mais au Canada, ce mod\u00e8le a un gros probl\u00e8me : des taxes inattendues le rendent beaucoup plus cher qu&rsquo;il ne devrait l&rsquo;\u00eatre ! <\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\"><strong>Comment fonctionne une hypoth\u00e8que Moucharakah d\u00e9gressive ?<\/strong><\/h3>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\">Au lieu de contracter un pr\u00eat traditionnel, l&rsquo;acheteur et la banque ach\u00e8tent ensemble un logement. Cela semble simple, n&rsquo;est-ce pas ? Malheureusement, la l\u00e9gislation fiscale canadienne complique les choses.  <\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\"><strong>Pourquoi la Moucharaka attire-t-elle plus d&rsquo;imp\u00f4ts ?<\/strong><\/h3>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\">Au Canada, toute vente d&rsquo;un bien immobilier entra\u00eene l&rsquo;application de taxes telles que l&rsquo;imp\u00f4t sur le revenu :<\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<ul class=\"wp-block-list\">\n<li><strong>Taxe sur les plus-values (\u00ab\u00a0CGT\u00a0\u00bb) &#8211; <\/strong>Taxe sur les b\u00e9n\u00e9fices r\u00e9alis\u00e9s lors de la vente d&rsquo;un bien immobilier<strong>. <\/strong><\/li>\n\n\n\n<li><strong>Taxe sur les transferts de propri\u00e9t\u00e9 (\u00ab\u00a0LTT\u00a0\u00bb) &#8211; <\/strong>Taxe sur les transferts de propri\u00e9t\u00e9<\/li>\n<\/ul>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\">Avec une hypoth\u00e8que Moucharaka, la maison est techniquement vendue deux fois :<\/p>\n\n<p class=\"wp-block-paragraph\">1. D&rsquo;abord, du vendeur initial au partenariat (acheteur + banque)<\/p>\n\n<p class=\"wp-block-paragraph\">2. Ensuite, progressivement du partenariat \u00e0 l&rsquo;acheteur<\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\">Chacun de ces transferts entra\u00eene des taxes suppl\u00e9mentaires, ce qui rend le co\u00fbt total de l&rsquo;achat d&rsquo;un logement beaucoup plus \u00e9lev\u00e9 que pr\u00e9vu<\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\"><strong>Exemple : Le co\u00fbt cach\u00e9 d&rsquo;une hypoth\u00e8que Moucharaka*<\/strong><\/h3>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\">Supposons qu&rsquo;un jeune couple musulman, Karim et Ayesha, ach\u00e8te une <strong> maison de 800 000 dollars<\/strong> en contractant un pr\u00eat hypoth\u00e9caire de type Moucharaka :<\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<ul class=\"wp-block-list\">\n<li><strong>Ils versent un acompte de 20 % = 160 000 $.<\/strong><\/li>\n\n\n\n<li><strong>Le pr\u00eateur halal contribue \u00e0 hauteur de 80 % = 640 000 $.<\/strong><\/li>\n\n\n\n<li><strong>Le taux de profit de la Moucharaka convenu est de 6,75 %.<\/strong><\/li>\n<\/ul>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\">Normalement, le co\u00fbt pour Karim et Ayesha serait bas\u00e9 sur ce taux. Mais comme la maison est techniquement <strong>vendue deux fois<\/strong>, ils doivent payer environ <strong> 340 000 dollars de taxes suppl\u00e9mentaires<\/strong>, ce qui fait passer le co\u00fbt r\u00e9el <strong>(\u00ab\u00a0TAEG\u00a0\u00bb) de 6,75 % \u00e0 11,91 % !<\/strong> C&rsquo;est presque le double du montant pr\u00e9vu. <\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">*Note : Le calcul ci-dessus est une estimation. Les calculs r\u00e9els d\u00e9pendent du revenu de chaque personne, du prix du logement et d&rsquo;autres facteurs ; veuillez v\u00e9rifier votre calcul sp\u00e9cifique avec votre avocat et votre conseiller fiscal. <\/p>\n<\/blockquote>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\"><strong>Une soci\u00e9t\u00e9 de partenariat pourrait-elle r\u00e9soudre ce probl\u00e8me ?<\/strong><\/h3>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\">Une solution possible consisterait \u00e0 acheter la maison dans le cadre d&rsquo;une soci\u00e9t\u00e9 ou d&rsquo;une soci\u00e9t\u00e9 en commandite, le pr\u00eateur et l&rsquo;acheteur poss\u00e9dant des parts dans la soci\u00e9t\u00e9. Au lieu de transf\u00e9rer directement la propri\u00e9t\u00e9, le pr\u00eateur vendrait des actions de la soci\u00e9t\u00e9 \u00e0 l&rsquo;acheteur. Cela signifie que la propri\u00e9t\u00e9 de la maison ne change pas techniquement puisque la soci\u00e9t\u00e9 ou la soci\u00e9t\u00e9 en commandite en est propri\u00e9taire. Les imp\u00f4ts sont donc \u00e9vit\u00e9s, n&rsquo;est-ce pas ?   <\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\"><strong>Malheureusement non<\/strong><\/h3>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\">L&rsquo;Agence du revenu du Canada (ARC) exige du pr\u00eateur qu&rsquo;il produise chaque ann\u00e9e des d\u00e9clarations sous serment d\u00e9clarant ces transferts d&rsquo;actions (car l&rsquo;ARC s&rsquo;int\u00e9resse aux changements directs ET\/OU indirects (b\u00e9n\u00e9fiques) de la propri\u00e9t\u00e9). Ces d\u00e9clarations sous serment d\u00e9clenchent une deuxi\u00e8me fois l&rsquo;imp\u00f4t sur les plus-values et l&rsquo;imp\u00f4t sur les mutations fonci\u00e8res. <\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\"><strong>Le d\u00e9sastre de la taxe hypoth\u00e9caire sur la Moucharaka au Royaume-Uni<\/strong><\/h3>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\">Un probl\u00e8me similaire s&rsquo;est pos\u00e9 au Royaume-Uni, o\u00f9 de nombreux emprunteurs de la Moucharaka sont aujourd&rsquo;hui confront\u00e9s \u00e0 des factures fiscales \u00e9normes et inattendues apr\u00e8s avoir pass\u00e9 inaper\u00e7us pendant des ann\u00e9es aupr\u00e8s des autorit\u00e9s fiscales britanniques. De plus, la garantie hypoth\u00e9caire est enregistr\u00e9e au nom du pr\u00eateur.
